The following article discusses Paul's conception of change regarding the resurrection body in 1 Cor 15:42‐44a. Our thesis is that Paul uses a popular Hellenistic cosmology and account of change to explain how the transformation of the body is possible. He uses seed imagery to contrast the pre‐and‐post‐resurrection bodies … the mortal and immortal bodies. Using rhetorical accommodation techniques, he resolves the Corinthian confusion regarding physical resurrection using popular Hellenistic ideas. Whereas some interpreters think that the resurrection body is terrestrial, (...) others find a rarefied extraction of matter like the Stoic material soul or a holistic transformation into a rarefied and/or celestial element fitted to a polarized heavenly environment. Our interpretation is characterized by material continuity and integrative rather than absolute polarity. Though Paul conceives of material continuity, he says nothing of rarefied bodies or their natural habitat. Jesus's resurrection and anticipated return suggest a transformation of the ‘flesh’ into a body capable of traversing both heavenly‐earthly spheres. Some think this view is incoherent, because it combines two incompatible conceptions of resurrection. Paul's solution seems to be that the resurrection body changes its properties as needed, depending on its environment. Hence, it never exemplifies incompatible properties at the same time. (shrink)

The following article evaluates two common arguments for preterist interpretations of Mark 13:24-27, collectively dubbed the ‘time-text’ argument. These two arguments support symbolic and/or historicised interpretations. Our thesis is that the first argument is unsound and the second commits the informal fallacy of false dilemma. Owing to these problems, the arguments and preterist interpretations should be rejected in favour of more plausible futurist interpretations.

The “land community” (or “biotic community”) that features centrally in Aldo Leopold’s Land Ethic has typically been equated with the concept of “ecosystem.” Moreover, some have challenged this central Leopoldean concept given the multitude of meanings of the term “ecosystem” and the changes the term has undergone since Leopold’s time (see, e.g., Shrader-Frechette 1996). Even one of Leopold’s primary defenders, J. Baird Callicott, asserts that there are difficulties in identifying the boundaries of ecosystems and suggests that we recognize that their (...) boundaries are determined by scientific questions ecologists pose (Callicott 2013). I argue that we need to rethink Leopold’s concept of land community in the following ways. First, we should recognize that Leopold’s views are not identical to those of his contemporaries (e.g., Clements, Elton), although they resemble those of some subsequent ecologists, including some of our contemporaries (e.g., O’Neill 2001, Post et al. 2007, Hastings and Gross 2012). Second, the land community concept does not map cleanly onto the concept of “ecosystem”; it also incorporates elements of the “community” concept in community ecology by emphasizing the interactions between organisms and not just the matter/energy flow of the ecosystem concept. Third, the boundary question can be illuminated by considering some of the recent literature on the nature of biological individuals (in particular, Odenbaugh 2007; Hamilton, Smith, and Haber 2009; Millstein 2009), focusing on concentrations of causal relations as determinative of the boundaries of the land community qua individual. There are challenges to be worked out, particularly when the interactions of community members do not map cleanly onto matter/energy flows, but I argue that these challenges can be resolved. The result is a defensible land community concept that is ontologically robust enough to be a locus of moral obligation while being consistent with contemporary ecological theory and practice. James è stato un pioniere degli studi culturali, spesso dimenticato ma importante per la sua influenza sul movimento nero e anticoloniale e sulle lotte operaie dalla fine degli anni Trenta agli anni Sessanta. Il saggio presenta una lettura critica di _American Civilization_ che James scrisse tra il 1949 e il 1950, pubblicato solo quattro anni dopo la sua morte nel 1989. Sebbene il manoscritto non sia mai stato completato, il suo significato (...) storico rimane intatto per la sua visione pervasiva degli Stati Uniti e per il suo modo di tradurre il pensiero marxiano nella cultura e nella politica statunitense. Mentre la storiografia ha preso in considerazione il manoscritto per il suo contributo agli studi culturali, il saggio lo considera come il suo “manifesto politico” per gli Stati Uniti. Collocando James nel contesto intellettuale del suo momento statunitense (1938-1953), il saggio ricostruisce la sua critica alla letteratura sociologica e manageriale, in particolare a Elton Mayo e Peter Drucker, e all’ascesa di una “filosofia controrivoluzionaria”, in particolare a Richard Weaver. _American Civilization_ porta alla luce una continua lotta operaia nella sua potenziale connessione con l’antagonismo nero e delle donne. _Riassunto_: Nel suo scritto intitolato _What is moving right now?_ Elton Marques cerca di rispondere alla domanda su cosa sia la _spotlight_ cui si riferisce la teoria temporale detta _Moving Spotlight Theory_ ed espone l’idea che si tratti del flusso di coscienza relativo ai nostri stati mentali. Dopo aver presentato la sua tesi, introduco un’ipotesi aggiuntiva allo scopo di risolvere una difficoltà presente nella sua interpretazione. Benché Marques non tenti di sostenere il modello della MST rispetto ad altri modelli (...) temporali, egli cerca di rendere la sua ipotesi convincente. Per questo motivo, io stesso metto qui a confronto il modello della MST (in particolare nella versione offerta da Marques) con altri modelli temporali, per valutarne la plausibilità all’interno del dibattito complessivo riguardante le principali teorie sul tempo, che pertanto vengono esposte nelle loro linee essenziali. _Parole chiave_: A-theory; B-theory; Growing Block Theory; Moving Spotlight Theory; Tempo _What is moving in MST? _ _Abstract_: In his paper entitled _What is moving right now?_ Elton Marques queries the nature of the _spotlight_ is in the _Moving Spotlight Theory_ of time, suggesting it is the flow of consciousness regarding our own mental states. After presenting his thesis, I introduce an additional hypothesis which helps resolve a problem with his proposal. Also, although Marques presents a convincing argument for his interpretation, he does not attempt to compare the MST model with other temporal models. I take up this challenge, comparing the MST model (specifically, the version offered by Marques) with other temporal models, pointing out essential characteristics and differences. Suppose libertarians could prove that durable, unqualified private property rights could be created through 'original acquisition' of unowned resources in a state of nature. Such a proof would cast serious doubt on the legitimacy of the modern state. It could also render the approach to property rights that I favour irrelevant. I argue here that none of the familiar Lockean-libertarian arguments for a strong natural right to acquisition succeed, and that any successful argument for grounding a right to acquire would (...) have to use my favoured approach to property rights - the 'vector-sum' approach. I conclude with some doubts about original acquisition theory and natural property rights. (shrink)

Disorders of Consciousness (DoCs) raise difficult and complex questions about the value of life for persons with impaired consciousness, the rights of persons unable to make medical decisions, and our social, medical, and ethical obligations to patients whose personhood has frequently been challenged and neglected. Recent neuroscientific discoveries have led to enhanced understanding of the heterogeneity of these disorders, and focused renewed attention on the medical and ethical problem of misdiagnosis. -/- This book examines the entanglement of epistemic and ethical (...) uncertainty in DoCs and other medical contexts, and how they interact to create both epistemic and ethical risks. Philosopher and bioethicist L. Syd M Johnson pulls together multiple threads in this work: the ontological mysteries of consciousness, medical uncertainty about unconsciousness, ableist bias, withdrawal of treatment in neurointensive care, and the rarely questioned view that consciousness is essential to personhood and moral status. Johnson challenges longstanding bioethical dogmas about DoC patients, and argues for an ethics of uncertainty for contexts where there is a need for decisive action in the presence of unavoidable uncertainty. The ethics of uncertainty refocuses ethical inquiry concerning persons with DoCs, placing less emphasis on their contested personhood, and more on inductive risk and uncertainty, on respect for autonomy, and especially on epistemic justice. With applications to various decisional contexts where uncertainty and ethical risk interact, this ethical approach enables surrogate decision makers facing fraught and risky choices to fulfill their obligations as moral and epistemic agents. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. Recent work in the ontology of music suggests that we will avoid confusion if we distinguish between two kinds of question that are typically posed in music ontology. Thus, a distinction has been made between fundamental ontology and higher-order ontology. The former addresses questions about the basic metaphysical options from which ontologists choose. For instance, are musical works types, indicated types, classes of particulars, or some other kind of entity? Higher-order ontology addresses the question of what lies ‘at the centre’ (...) of a specific form of music, such as rock or jazz—or perhaps classical music. The argument of this essay is, first, that a close examination of the best efforts in two of these territories shows that they have the effect of pressing the music in each sphere into implausible Procrustean beds. Second, it is argued that the general question that higher-order ontologies pose, that is, ‘What work-kind is it that lies at the centre of a given kind of music, F?’ is a question based on a mistaken but seductive assumption, namely that the concept of the work of F has actual application. In fact, these concepts—upon which higher-order ontology depends—are mere artefacts of philosophy. The question is also addressed why the assumption is so seductive. Finally, the question finally is posed about what, if anything, is implied from the foregoing about the traditional ontology of classical music. (shrink)

This paper continues a discussion concerning the distinction between disability and handicap initiated in this volume by Steven D. Edwards. Edwards argues that the reasons advanced by the WHO for this distinction in its International Classification of Impairments, Disabilities and Handicaps (ICIDH) are not valid. Edwards also criticizes my own quite different grounds for distinguishing between the two concepts. His general conclusion is that the distinction is superfluous. In this paper I claim that Edwards's reasoning is invalid. I present five (...) arguments for my case, viz., the arguments from: a) practical necessity, b) cost-effectiveness, c) clinical practice, d) the subject's vital goals, and e) the universal presence of some basic action. My own conclusion thus is that there is a need within health care for a distinction between disabilities and handicaps. I also indicate that there may be a need for further distinctions along the dimension of action-generation which is presented in the paper. (shrink)

Moral Case Deliberations are reflective dialogues with a group of participants on their own moral dilemmas. Although MCD is successful as clinical ethics support, it also has limitations. 1. Lessons learned from individual MCDs are not shared in order to be used in other contexts 2. Moral learning stays limited to the participants of the MCD; 3. MCD requires quite some organisational effort, 4. MCD deals with one individual concrete case. It does not address other, similar cases. These limitations warrant (...) research into complementary ways of providing CES to healthcare professionals. Our research objective was therefore to develop a low threshold CES tool based on a series of MCDs on autonomy in long-term care. We used a qualitative research design in which we analyzed the process and content of a series of MCDs, combined with reflections on the theoretical background of MCD. In total 28 MCDs were analyzed by means of a thematic content analysis. In various rounds of development, the results of the analysis were combined with theoretical reflections on CES. Consequently, the tool was evaluated in three focus groups and adjusted. The CES tool, called ‘moral compass’, guides the users through a series of six subsequent questions in order to methodically reflect on their concrete moral dilemma, in the form of a booklet of 23 pages. It combines a methodical element that encourages and structures a reflection process with a substantive element, including norms, values, options, strategies, and insights regarding dealing with client autonomy. By using data from a series of MCDs, combined with theoretical reflections on MCD, ethics support and moral learning, we developed a thematic, low-threshold CES tool that supports healthcare professionals in daily practice in dealing with moral questions regarding client autonomy. It integrates examples and insights from earlier MCDs on the same topic. The moral compass is not a replacement of, but can be used complementary to MCD. The feasibility and impact of the moral compass need to be investigated in an evaluative follow-up study. The methodology presented in this paper may be used to develop moral compasses on different topics in various healthcare organizations. (shrink)

The image of Antonio Salieri is recreated based on the memories of his contemporaries and epistolary and journalistic literature. The author, relying on memoir literature, archival documents and journalistic sources, substantiates his own position regarding A. Salieri’s contribution to the world artistic treasury and artistic higher education, the expediency of researching his heritage at the current stage. A wide range of primary sources little-known in scientific circulation are used, which allow us to reveal the image of Antonio Salieri – a (...) musician, composer, teacher, theater director, rector of the central art institution of higher education in Europe in the 19th century – the Vienna Conservatory. The concept of A. Salieri’s involvement in the early death of is refuted Mozart. The aim consists in recreating the image of Antonio Salieri based on the memories of his contemporaries and epistolary and journalistic literature. The tasks of the research are the analy of primary sources on this issue and the identification of modern approaches to Antonio Salieri’s contribution to the world artistic treasury. Research methods. The methodology of the author’s research is based on the content-comparative method, which allows you to determine the reliability of one or another source, the ratio of traditionally established and non-traditional vision of the image of a prominent representative of his era – Antonio Salieri. Reconstruction was also used – to reproduce the events of the era at the turn of the 18 – 19th centuries within the scope of the research. Research results: The development of the pedagogical heritage of A. Salieri in the activities of his students and followers is shown; the creative portrait of Y.N. Hummel, who, thanks to the Maestro, mastered vocal art, Italian musical terminology, music theory and solfeggio, choral singing and conducting, orchestration, pedagogical skills, combined “Salierian” classicism and his own romanticism. The achievements of Fortunata Valzel-Franchetti as a singer, artist and teacher are analyzed, and it is shown how the vocal-pedagogical school of A. Salieri came to Ukraine through her. Conclusion.The analysis of primary sources –correspondence, diaries of Antonio Salieri and his students, made it possible to find out the significance of the Maestro’s creative heritage for subsequent eras, to recreate his image based on the memories of his contemporaries and epistolary and journalistic literature. 27 archival cases were presented for consideration, which gave an opportunity to understand how domestic scientists, artists and publicists treated Antonio Salieri throughout the 20th century, so often they turned to his creative heritage. After careful analysis of these materials, it can be said that their assessment was very high. (shrink)

There is no subject at the interface of law, psychiatry and medical ethics which is more controversial than psychosurgery. The divergent views of the treatment begin with its definition. The World Health Organisation1 and others2 define psychosurgery as the selective surgical removal or destruction of nerve pathways or normal brain tissue with a view to influencing behaviour. However, proponents of psychosurgery demur on the basis that the `modern' treatment is concerned predominantly with emotional illness, without any specific effect upon behaviour. (...) The alternative definition offered is `the surgical treatment of certain psychiatric illnesses by means of localised lesions placed in specific cerebral sites.3It is difficult entirely to accept this definition because, as examined below, scientific psychiatry is not yet in a position to directly treat psychiatric illness solely through surgical intervention. There is no reliable theoretical relationship between particular cerebral sites (which are normal and healthy) and an identifiable psychiatric illness or symptomatology. Given this state of psychiatric understanding, it is misleading to suggest fine distinctions between generalised alteration of behaviour or mood and treatment of an illness. Highly divergent practices and theories (relating to the multiplicity of conditions treated, surgical methods adopted and areas of the brain operated upon) further undermine exaggerated claims that psychosurgery can scientifically `treat' specific illness through precise surgical intervention. Nonetheless, contemporary psychosurgery does not contain quite the same `broadbrush' approach of its ancestors and it can lay some legitimate claim as an effective empirical treatment in narrowly limited circumstances. Major ethical problems still, however, arise and these will be discussed in this article. (shrink)

This paper is the result of a contribution between ethics and law, which will be used as thought-process tools, to address the complex issue of legal and ethical statuses of GM fish. To find answers, we propose to consider this issue from a wider angle, looking at the relations between the human, animal, and living worlds. We show that it is possible to construct other forms of intellectual logic that, without setting these worlds in opposition, do not lapse into relativism (...) where boundaries are blurred. In this sense, we submit the hypothesis that ordered pluralism should help us to move past a mere Man–Animal relationship to reveal the entire complexity of relationships within mankind and between mankind and other (non-human) worlds alongside it and to which it belongs: the animal and living worlds. With this new logic, “animal ethics” and “animal law” are re-embedded into a set of relationships. This logic emerges from a new consideration: the nature of the contemporary objects we are dealing with. We shall call objects like genetically modified fish “relational objects” in the sense that in order to be apprehended, they utilize a set of relationships of which there are just as many as the dimensions forming them, not as predicates but as primary constituents. Experimentally, in the case of GM fish, we translate this by proposing to typologize legal and ethical considerations induced by multiple relations connected to this object. According to the type of relationship in question, the GM fish will not have the same status; it is a changing object that must be suitably apprehended. (shrink)

Kur’ân’daki incelikleri kavrayıp yorumlaması için Rasûlullah’ın özel duasına mazhar olan Abdullâh b. Abbâs, fetvaları oldukça meşhur fakih bir sahâbîdir. Rasûlullah’ın sünnetini anlamaya yönelik çabaları sahâbenin gözlemine bağlı olarak farklılık arz etmektedir. Ayrıca onların her birinin hadisleri anlayış ve kavrayışları aynı seviyede değildi. Bundan dolayı rivâyetler hususunda farklı anlayışlar, yorumlamalar, unutmalar ve yapılan hatalar sebebiyle sahâbe birbirini tenkit etmiştir. Büyük bir ilmi (...) birikime sahip olan İbn Abbâs sahâbeden mirasa dair nakledilen bazı rivâyetleri, uygulama ve fetvaları düzeltmiş ve onları tenkit etmiştir. İbn Abbâs’ın hayatına ve hadis, tefsir ve fıkıh ilmindeki konumuna dair çalışmalar yapılmıştır. Ancak onun ferâiz hususundaki istidrâkleri hadis ilmi açısından incelenmemiştir. Araştırmamızda onun hadis ilmi çerçevesinde Rasûlullah’ın sözlerinin ve uygulamasının doğru anlaşılması için mirasa dair yaptığı istidrâkleri ele alınmıştır. Abdullāh Ibn Abbās is one of the companions well known for his verdicts in the area of the Islamic law of inheritance and the abundance of his verdicts in jurisprudence. In this regard, the inheritance sections of the jurisprudence books often include Ibn Abbās's verdicts and applications. He approached the matters regarding jurisprudence from a different perspective, ruled differently from the companions, and provided corrections mainly in terms of the science of inheritance regarding the sayings narrated by the companions, applications and verdicts of the companions. In this regard, Ibn Abbās considered the jurisprudential aspects of the sayings and applications of Prophet Muhammad and made a ruling by interpreting the same narration by his wide understanding and knowledge and considering the meaning of the sayings. Ibn Abbās, who made different interpretations and evaluations in his corrections regarding the law of inheritance, objected to Umar Ibn Al-Khattab and Uthman Ibn Affan, criticized and corrected the narrations of Zayd Ibn Thabit. Ibn Abbās, who interpreted the matters regarding inheritance according to the principles of the Qur'ān, made rulings according to the apparent meanings of the related verses of the Qur'ān. (shrink)
